NISS for employees: the contract catch-22 and how employers file
New arrivals in Portugal meet the same circle: an employer asks for a NISS before signing a contract, while Seguranca Social asks for a signed contract before issuing a NISS. The circle has an official answer, and the contract wins.
The rule: contract first, then NISS
An employer can sign an employment contract before the worker holds a NISS. The signed contract is then the proof of work used to request the number, and the employer must report the hiring to Seguranca Social by the worker’s first day of work. AIMA confirmed this order in February 2026: the contract is not blocked by the missing number.
How employer filing works
Once the contract is signed, the employer requests the NISS as the worker’s representative for this purpose and communicates the employment link through Seguranca Social Direta. The worker provides a passport or ID, the NIF, and for non-EU workers the residence permit, visa or residence application receipt.
When the employer will not file
Some employers, especially small ones hiring their first foreign worker, prefer the worker to arrive with the number ready. In that case you file yourself, or through a representative, using the signed contract as proof. What does not work is a promise of a job: offers and emails are not accepted as proof of work.
Check the result
After your first salary, check Seguranca Social Direta after the 20th of the following month. Your employment link and contributions should appear under your NISS. If they do not, raise it with your employer straight away, because gaps in the record affect future benefits.
